A proper OEM brief should identify the actual construction:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Core material, thickness, cell size, and density<\/li>\n\n\n\n<li>Perimeter-foam material, hardness, width, and location<\/li>\n\n\n\n<li>Face layup and fiber orientation<\/li>\n\n\n\n<li>Resin and adhesive system<\/li>\n\n\n\n<li>Thermoforming temperature, pressure, and dwell-time window<\/li>\n\n\n\n<li>Edge and handle construction<\/li>\n\n\n\n<li>Finished weight, swing weight, and balance range<\/li>\n\n\n\n<li>Surface material and finishing process<\/li>\n\n\n\n<li>Target power, spin, deflection, and durability values<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Brands evaluating&nbsp;<a href=\"https:\/\/nexapaddle.com\/nl\/advanced-tech-thermoformed-paddles\/\" target=\"_blank\" rel=\"noreferrer noopener\">advanced-tech and thermoformed paddles<\/a>&nbsp;should treat \u201cGen 3\u201d as the start of a technical conversation, not as an adequate purchase specification.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The 2026 JOOLA Patent Risk: Why Gen 3 and Some Gen 4 Designs Need an FTO Review<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The patent issue is separate from USAP or UPA-A performance compliance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sport Squad, Inc., doing business as JOOLA, is the assignee of at least two U.S. utility patents now being asserted against competing pickleball paddle suppliers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>U.S. Patent No. 12,465,826 (the \u2019826 patent)<\/strong>, issued November 11, 2025<\/li>\n\n\n\n<li><strong>U.S. Patent No. 12,357,891 (the \u2019891 patent)<\/strong>, issued July 15, 2025<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The patents belong to the same broader patent family and claim priority to provisional applications filed in 2023. They concern paddle cores, gaps or voids, filler materials, and perimeter or frame structures\u2014not the commercial labels \u201cGen 3\u201d or \u201cGen 4.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What the Published Claims Actually Focus On<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Patent infringement is evaluated claim by claim. A product generally creates literal-infringement risk only when every limitation of at least one asserted claim is present; visual similarity or use of PP honeycomb alone is not enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At a high level, claim 1 of the \u2019826 patent describes a pickleball paddle with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Front and back surfaces<\/li>\n\n\n\n<li>A core whose outer boundary has one portion terminating farther inside the paddle than another portion<\/li>\n\n\n\n<li>A gap outside the core and between the core boundary and the paddle\u2019s internal perimeter<\/li>\n\n\n\n<li>A first filler in at least part of that gap<\/li>\n\n\n\n<li>A frame around at least part of the paddle head, with a hollow interior<\/li>\n\n\n\n<li>A second filler within at least part of the frame\u2019s hollow interior<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The \u2019891 patent includes claims directed to other arrangements, including gaps in the core near both sides of the throat, filler placed in one or more of those gaps, and associated frame or additional filler structures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means&nbsp;<strong>PP honeycomb by itself is not the complete issue<\/strong>. The higher-risk question is whether a PP honeycomb\u2014or another core material\u2014is cut back, relieved, gapped, surrounded, or combined with fillers and a frame in the particular arrangement required by a patent claim.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"2560\" height=\"1441\" src=\"https:\/\/nexapaddle.com\/wp-content\/uploads\/2026\/07\/gen3-eva-foam-core-scaled.jpg\" alt=\"\" class=\"wp-image-3250\" srcset=\"https:\/\/nexapaddle.com\/wp-content\/uploads\/2026\/07\/gen3-eva-foam-core-scaled.jpg 2560w, https:\/\/nexapaddle.com\/wp-content\/uploads\/2026\/07\/gen3-eva-foam-core-768x432.jpg 768w, https:\/\/nexapaddle.com\/wp-content\/uploads\/2026\/07\/gen3-eva-foam-core-1536x864.jpg 1536w, https:\/\/nexapaddle.com\/wp-content\/uploads\/2026\/07\/gen3-eva-foam-core-2048x1153.jpg 2048w, https:\/\/nexapaddle.com\/wp-content\/uploads\/2026\/07\/gen3-eva-foam-core-18x10.jpg 18w, https:\/\/nexapaddle.com\/wp-content\/uploads\/2026\/07\/gen3-eva-foam-core-600x338.jpg 600w\" sizes=\"(max-width: 2560px) 100vw, 2560px\" \/><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\">Why Gen 4 Can Be Close to Gen 3 for Patent Purposes<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The industry\u2019s generation names are inconsistent. Some \u201cGen 4\u201d paddles use a substantially different full-foam architecture. Others retain a central PP honeycomb core while changing the quantity, position, or mechanical role of foam and other filler materials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A full-foam paddle is\u00a0<strong>not automatically outside<\/strong>\u00a0the patents.<\/li>\n\n\n\n<li>A PP honeycomb paddle is\u00a0<strong>not automatically inside<\/strong>\u00a0the patents.<\/li>\n\n\n\n<li>A Gen 4 marketing label does not avoid a claim that covers the actual arrangement.<\/li>\n\n\n\n<li>Moving or changing the foam is useful only if the revised design omits at least one required claim limitation and also avoids other relevant claims and the doctrine of equivalents.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The correct analysis is a limitation-by-limitation claim chart based on a sectioned production paddle, drawings, bill of materials, and manufacturing method.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Risk Is No Longer Theoretical<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">On June 4, 2026, the U.S. International Trade Commission instituted Investigation No. 337-TA-1503 based on JOOLA\u2019s complaint. The investigation covers alleged infringement of claims from the \u2019826 and \u2019891 patents in connection with imported pickleball paddles. JOOLA requested a limited exclusion order and cease-and-desist orders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ITC described the accused product category broadly as pickleball paddles \u201cwith a core, comprised of foam or other material, and various filler material(s).\u201d This reinforces that the dispute is not confined to a single PP-honeycomb product name.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ITC also expressly stated that instituting the investigation was&nbsp;<strong>not a decision on the merits<\/strong>. As of this article\u2019s July 26, 2026 fact-check date, the investigation should be described as pending\u2014not as proof that every accused paddle infringes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">JOOLA and Paddletek Group separately announced a settlement concerning the Paddletek Reserve, HoneyFoam, and ProXR Signature Jolt products. According to that joint announcement, the relevant products will carry JOOLA\u2019s propulsion-core patent number and royalties will be paid. A settlement is a meaningful commercial warning, but it is not a judicial ruling that defines the full scope or validity of the patents.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Minimum FTO Workflow Before a U.S. Launch<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Before quoting or approving a Gen 3 or Gen 4-style OEM model for the United States:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Freeze the internal architecture.<\/strong>\u00a0Record the core boundary, all gaps, filler locations, frame cross-section, materials, and manufacturing sequence.<\/li>\n\n\n\n<li><strong>Commission a U.S. freedom-to-operate search.<\/strong>\u00a0At minimum, review the \u2019826 and \u2019891 patents, their continuations and related family members, plus patents owned by other paddle companies.<\/li>\n\n\n\n<li><strong>Prepare a claim chart.<\/strong>\u00a0Map every limitation of the relevant independent and dependent claims to the proposed product.<\/li>\n\n\n\n<li><strong>Decide the commercial path.<\/strong>\u00a0Obtain a non-infringement opinion, design around the claims, seek a license, or do not sell\/import the model in the U.S.<\/li>\n\n\n\n<li><strong>Control production changes.<\/strong>\u00a0A supplier substitution or foam-layout change can alter both tournament performance and the patent analysis.<\/li>\n\n\n\n<li><strong>Keep territory-specific SKUs when necessary.<\/strong>\u00a0A structure intended for other markets should not automatically be offered to a U.S. buyer.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">If a structure cannot obtain acceptable U.S. FTO clearance, a brand may consider a Europe-only, Asia-only, or other territory-specific SKU\u2014but only after counsel reviews the patent landscape in each destination country. A U.S. patent is territorial, yet related European, Chinese, Korean, or other national patents and applications may exist in the same family. Market segmentation requires separate model numbers, packaging, sales-channel restrictions, distributor instructions, and controls that prevent the non-U.S. SKU from being diverted into the United States.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An OEM factory can provide drawings, cut sections, BOM records, and process evidence. It should not promise \u201cpatent-free\u201d status without a qualified legal review covering the final product and sales territory.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Put Patent Responsibility Into the OEM Contract<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An FTO review answers a technical-legal question; the supply agreement determines who carries the commercial loss if a dispute still arises. Brand owners should not leave patent responsibility to an email promise or a generic statement that the product is \u201coriginal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Counsel should consider addressing:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>IP warranty:<\/strong>\u00a0what the supplier is actually warranting, for which design, countries, and period<\/li>\n\n\n\n<li><strong>Disclosure duty:<\/strong>\u00a0whether the supplier must identify third-party designs, licensed technology, prior disputes, and known claims<\/li>\n\n\n\n<li><strong>Indemnification:<\/strong>\u00a0which infringement claims, defense costs, settlements, recalls, inventory losses, or import holds are covered<\/li>\n\n\n\n<li><strong>Control of defense:<\/strong>\u00a0who selects counsel, controls settlement, and communicates with the claimant<\/li>\n\n\n\n<li><strong>Remedies:<\/strong>\u00a0redesign, replacement, refund, license procurement, or order cancellation<\/li>\n\n\n\n<li><strong>Liability limits:<\/strong>\u00a0whether ordinary contractual caps exclude IP claims and whether the supplier has sufficient assets or insurance to support the promise<\/li>\n\n\n\n<li><strong>Change control:<\/strong>\u00a0written approval before any core, filler, frame, material, or process substitution<\/li>\n\n\n\n<li><strong>Evidence retention:<\/strong>\u00a0drawings, BOM revisions, lot records, test reports, and samples needed to defend the design<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Contract language is not a substitute for clearance. A broad indemnity from a thinly capitalized supplier may have little practical value, and a brand that specifies or supplies the accused design may retain substantial exposure. Allocate responsibility only after both parties have disclosed who designed each feature and who controls U.S. sales.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The Two Certification Paths Brands Need to Understand<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no single paddle certificate covering every level of competitive pickleball in the United States.
