They concern paddle cores, gaps or voids, filler materials, and perimeter or frame structures\u2014not the commercial labels \u201cGen 3\u201d or \u201cGen 4.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What the Published Claims Actually Focus On<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Patent infringement is evaluated claim by claim. A product generally creates literal-infringement risk only when every limitation of at least one asserted claim is present; visual similarity or use of PP honeycomb alone is not enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At a high level, claim 1 of the \u2019826 patent describes a pickleball paddle with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Front and back surfaces<\/li>\n\n\n\n<li>A core whose outer boundary has one portion terminating farther inside the paddle than another portion<\/li>\n\n\n\n<li>A gap outside the core and between the core boundary and the paddle\u2019s internal perimeter<\/li>\n\n\n\n<li>A first filler in at least part of that gap<\/li>\n\n\n\n<li>A frame around at least part of the paddle head, with a hollow interior<\/li>\n\n\n\n<li>A second filler within at least part of the frame\u2019s hollow interior<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The \u2019891 patent includes claims directed to other arrangements, including gaps in the core near both sides of the throat, filler placed in one or more of those gaps, and associated frame or additional filler structures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means&nbsp;<strong>PP honeycomb by itself is not the complete issue<\/strong>. Some \u201cGen 4\u201d paddles use a substantially different full-foam architecture. Others retain a central PP honeycomb core while changing the quantity, position, or mechanical role of foam and other filler materials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A full-foam paddle is\u00a0<strong>not automatically outside<\/strong>\u00a0the patents.<\/li>\n\n\n\n<li>A PP honeycomb paddle is\u00a0<strong>not automatically inside<\/strong>\u00a0the patents.<\/li>\n\n\n\n<li>A Gen 4 marketing label does not avoid a claim that covers the actual arrangement.<\/li>\n\n\n\n<li>Moving or changing the foam is useful only if the revised design omits at least one required claim limitation and also avoids other relevant claims and the doctrine of equivalents.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The correct analysis is a limitation-by-limitation claim chart based on a sectioned production paddle, drawings, bill of materials, and manufacturing method.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Risk Is No Longer Theoretical<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">On June 4, 2026, the U.S. International Trade Commission instituted Investigation No. 337-TA-1503 based on JOOLA\u2019s complaint. The investigation covers alleged infringement of claims from the \u2019826 and \u2019891 patents in connection with imported pickleball paddles. JOOLA requested a limited exclusion order and cease-and-desist orders.<\/p>\n\n\n\n<p
